Terms of Service

By accessing and using Fade ("the App"), you accept and agree to be bound by these Terms of Service.

Summary

  • Fade connects you with hair salons; your contract for the service is with the salon, not with us.
  • You must inform salons of allergies or health conditions that may affect the service.
  • We are not liable for salon services, quality, or conduct.

1. Acceptance of Terms

By downloading, installing, accessing, or using the Fade mobile application or website, you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Vera IT ("we", "us", "our").

If you do not agree to these Terms, you must not use the App and should uninstall it immediately.

We recommend that you save or print a copy of these Terms for future reference.

Key Terms

When we use these terms below, they have the following meanings:

  • App / Platform: The Fade mobile application and website (getfadeapp.com)
  • User / Client: You, the person using the App to discover and book salon services
  • Salon / Partner: A hair salon or barbershop listed on the platform that provides services
  • Booking / Appointment: A reservation you make for a service at a salon through the App
  • Service: The hair or grooming service provided by a salon

2. Description of Service

Fade provides a platform that connects users with hair salons. Our services include:

  • Salon Discovery: Location-based search and interactive map
  • Booking System: Schedule appointments directly with salons
  • Messaging: Direct communication between users and salons
  • Reviews & Ratings: Share and read experiences
  • QR Code Check-In: Quick check-in at salons
  • Payment Processing: Secure payment via Apple Pay/Google Pay
  • Premium Features: Salon promotion and visibility via subscriptions

Intermediary role: We act as an intermediary between you and salons. When you make a booking, the contract for the service is between you and the salon. We are not a party to that contract.

As-Is Service: The service is provided "as is" and "as available". We reserve the right to modify, suspend, or discontinue any feature at any time without prior notice.

3. User Accounts

To use certain features, you must create an account. You agree to:

3.1 Account Requirements

  • Be at least 13 years old (COPPA compliance)
  • Provide accurate, current, and complete information
  • Maintain only one account per person
  • Maintain account security and password confidentiality
  • Accept responsibility for all activity under your account

3.2 Account Suspension/Termination

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, harass others, or attempt to circumvent security measures.

4. User Conduct

You agree NOT to:

  • Use the App for any illegal purpose
  • Harass, abuse, threaten, or harm others
  • Post false, misleading, or defamatory information
  • Gain unauthorized access to the App or other accounts
  • Interfere with proper functioning of the App
  • Use bots or scrapers without permission
  • Collect user data without consent
  • Impersonate another person or entity
  • Upload viruses or malicious code
  • Reverse engineer or decompile the App

5. Bookings and Payments

5.1 Making Bookings

  • Arrive on time for scheduled appointments
  • Inform the salon of any allergies, health conditions, medications, or special needs that may affect the service. Failure to do so may result in harm; neither we nor the salon are liable for consequences that could reasonably have been avoided if you had disclosed this information.
  • Cancellation policies are set by individual salons
  • Deposits may be required and non-refundable in case of no-show
  • You are responsible for charges incurred

Service communications: By using Fade you agree to receive service communications (e.g. booking confirmations, reminders, messages from salons) via push notification, email, or in-app. You can disable push notifications in device settings.

5.2 Payment Processing

Mobile app: Payments (subscriptions, Featured promotions) are processed via Apple (iOS) or Google Play (Android). Website: Salon subscriptions on getfadeapp.com are processed by Stripe. We do not store card details. Prices are set by salons. Disputes between users and salons are not our responsibility—resolve directly with the salon.

6. Salon's Right to Refuse or Cancel

Salons have the right to refuse, reject, or cancel a booking at their sole discretion when they reasonably determine that something is not in order or when refusal is necessary to protect their business, staff, other customers, or to comply with legal obligations.

Grounds may include (but are not limited to):

  • Safety concerns: threat, aggressive behavior, risk to staff or customers
  • Hygiene or health: infectious disease, severe allergies
  • Privacy or identity: inability to verify identity
  • Capacity: fully booked, understaffed, unable to provide service
  • Professional judgment: service cannot be performed safely
  • Fraud or misuse: fraudulent booking, fake identity
  • Customer history: repeated no-shows, past misconduct
  • Legal or regulatory compliance
  • Other legitimate business reasons: closure, equipment failure, force majeure

Obligation to inform: The salon should inform the customer as soon as reasonably possible. The salon is not required to disclose the specific reason if doing so would compromise safety, privacy, or legal obligations. Fade's role: Fade does not interfere with a salon's decision. Fade is not liable for any refusal or cancellation. Disputes are between customer and salon.

7. Reviews and Ratings

When posting reviews, you agree to:

  • Reviews must be based on genuine personal experience
  • No offensive, defamatory, or inappropriate content
  • No fake reviews or reviews for competitors
  • You grant us a worldwide, royalty-free license to use your content

We may remove reviews that violate these Terms. Salons may respond publicly.

8. Intellectual Property

All content in the App is owned by Vera IT or its licensors (design, UI, source code, Fade name and logo). You may not copy, modify, distribute, or lease any part without written permission. User-generated content remains your property but you grant us a worldwide, non-exclusive license to use it for operating the App.

9. Salon Responsibilities

Salons using Fade agree to:

  • Provide accurate business information
  • Honor appointments made through the App
  • Maintain professional conduct
  • Comply with local laws and licensing
  • Pay applicable subscription fees
  • Not misuse customer data

Salons are independent businesses. Fade is not responsible for salon services, quality, or conduct.

10. Subscriptions and In-App Purchases

Fade offers subscription tiers for salons: Starter (€54/month, up to 2 staff), Medium (€75/month, up to 5 staff), Pro (€95/month, unlimited staff). 6 months: 10% off. Yearly: 20% off. Promotions: Top (€15/day, €80/week, €250/month) and Premium (€10/day, €50/week, €150/month). All prices incl. VAT. Subscriptions are billed via Apple/Google in the app, auto-renew unless canceled at least 24 hours before renewal. Refunds follow Apple/Google policies. To cancel: iOS: Settings > Subscriptions > Fade. Android: Google Play > Subscriptions > Fade.

Appointment reminders: Salons on Starter can send reminders only to clients who have added them to "My Hairdresser" (favorites). Medium and Pro salons can send reminders to all clients with appointments. See our Privacy Policy for details.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VERA IT SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, USE, GOODWILL. WE ARE NOT LIABLE FOR SALON SERVICES, REFUSALS, CANCELLATIONS, OR DISPUTES BETWEEN USERS AND SALONS.

Our total liability shall not exceed the greater of: (a) the amount you paid us in the last 12 months, or (b) €100. The App is provided "AS IS" without warranties.

12. Indemnification

You agree to indemnify and hold harmless Vera IT, its officers, directors, employees, and agents from any claims, liabilities, damages, or expenses arising from your violation of these Terms, violation of law, misuse of the App, your content, or your interaction with salons or other users.

13. Termination

By you: Delete account via Settings > Account > Delete Account or contact support@getfadeapp.com. Data deleted within 30 days (see Privacy Policy).

By us: We may terminate or suspend your account for violations, fraudulent activity, harassment, prolonged inactivity, or at our sole discretion.

Upon termination: your right to use the App ceases immediately; we may delete your data; outstanding payments remain due. Liability, indemnification, and governing law provisions survive.

14. Changes to Terms

We may modify these Terms at any time. We will update the "Last Updated" date and may notify you for significant changes. Your continued use constitutes acceptance. If you disagree, you must stop using the App and delete your account.

15. Governing Law

These Terms are governed by the laws of Germany. Disputes shall be resolved in the courts of Germany. For EU consumers, nothing in these Terms limits your statutory rights. For disputes under €5,000, you may choose binding arbitration.

17. Miscellaneous

Entire Agreement: These Terms together with our Privacy Policy constitute the entire agreement.

Severability: If any provision is unenforceable, the remaining provisions remain in effect.

No Waiver: Our failure to enforce any right does not waive that right.

Assignment: You may not assign these Terms without our consent. We may assign without restriction.

Force Majeure: We are not liable for failure or delay due to circumstances beyond our control (natural disasters, war, strikes, pandemics).
